We paid a 10,000 retainer to an attorney with a flat fee contract. The attorney was not promorming up to our standards so we released him. We have had him for two months and all he has done is see my son teice in jail once to introduce himself and once to go over a witness statement. He postponed the preliminary hearing without any communication to the inmate and never went to the jail to tell him. I receveid a call on Staurday. I have asked for an itemized statement of his services and a refund of dollars not used. He left me a message saying he doesn't owe me anything infact I owe him an additional 10,000. All he did was get the discovery. Does he have to give me a breakdown of expenses and return most of my retainer?
