         <description><![CDATA[<p>In order to answer the question, you have to know, if the payment is maintenance or equitable distribution. </p>

<p>A maintenance or alimony payment may be taxable, equitable distribution is generally not.  But you may have, for instance, have a capital gain for a property conveyed by the agreement, but later sold.</p>

<p>Bottom line, the agreement need be reviewed.</p>]]></description>
