An Engagement Ring Must Be Returned If There is No Marriage

If parties do not wed, the engagement ring must be returned.   A engagement ring is a gift made in contemplation of marriage. The engagement ring is a conditional gift and if the marriage does not take place, the condition has not been satisfied and the ring must be returned. 

Despite this “golden rule,” it is sometimes necessary to litigate to compel the return of the ring. Indeed, I had to file one such action this week.

With only one exception, the reason the parties failed to marry is irrelevant.

I received an engagement ring, but the wedding was called off because the man in this relationship basically moved in, did not pay for anything, had me pay for many of his personal things and situations in his life (credit cards, etc). I offered to pay a percentage of the ring, but i will not give him this ring back... I already gave him enough money..

Christmas of 2005 he Proposed to me. On Feb. 2007 I broke off the engagement. I tried to give back the ring and he refused it. Now 3 months later he wants it back and is threatening to take me to small case court. But I sold it to a Pawn shop 2 weeks ago.
I'm I going to have to pay him back for the ring?
